LHC Justice Mohsin Akhtar Kayani Resigns, Citing Conscience and Judicial Independence

Lahore High Court Justice Mohsin Akhtar Kayani resigned on Wednesday, 28 October, sending his resignation to President Asif Ali Zardari for approval. In his letter, reported by Dawn and other local media, he cited health reasons following recent surgery alongside what he called reasons of conscience, saying his conscience did not permit him to continue on the bench.

Justice Kayani wrote that the changes brought through the 26th and 27th Constitutional Amendments had harmed the independence and institutional integrity of the high courts. He argued that growing executive control over judicial institutions, including the appointment and transfer of judges, had seriously weakened public trust in judicial independence and the fairness of proceedings, with ordinary litigants — the principal stakeholders of the justice system — suffering most.

The resignation follows a turbulent year for the judge. He joined the Lahore High Court in April 2026 after serving at the Islamabad High Court, where he was a senior puisne judge, and was recently posted to the court's Rawalpindi bench in a judicial reshuffle. During his career he says he disposed of more than 23,000 cases. He was due to retire in February 2032, but says he now plans to return to legal practice to serve the public and promote legal awareness.
