Peshawar High Court Issues Notice to Attorney General on PTI's Challenge to KP Emergency Rule

Peshawar High Court Issues Notice to Attorney General on PTI

The Peshawar High Court on Tuesday issued a notice to the attorney general on petitions filed by Pakistan Tehreek-e-Insaf (PTI) challenging the imposition of governor's rule and a state of emergency in Khyber Pakhtunkhwa.

A two-member bench comprising Justice Ijaz Anwar and Justice Faheem Wali heard petitions filed by PTI Chairman Barrister Gohar Ali Khan and Advocate Salman Khan, who asked the court to declare the measures unconstitutional and set them aside.

The PML-N-led federal government imposed the emergency and governor's rule in KP on October 11, removing the PTI-led provincial government that had ruled the province since 2013. The government cited rising terrorism incidents and the provincial government's lack of support for counterterrorism operations.

KP Governor Faisal Karim Kundi has since taken charge of the province with the help of an 11-member technocratic advisory council. During Tuesday's hearing, Barrister Gohar told the court that the emergency, the governor's rule and the advisory council were all imposed on the same day, along with the transfer of 38 deputy commissioners. The petitioners' counsel argued that an emergency can only be imposed in the event of war or external aggression — "there is neither war nor external aggression here."
