Peshawar High Court Issues Notices on PTI Challenge to KP Governor's Rule

The Peshawar High Court on Tuesday issued notices to the federal government, the attorney general and the advocate general on petitions challenging the imposition of governor's rule and emergency in Khyber Pakhtunkhwa. A two-member bench of Justice Ijaz Anwar and Justice Faheem Wali heard petitions filed by PTI Chairman Barrister Gohar Khan and Advocate Salman Khan, who have asked the court to declare both measures unconstitutional and set them aside. The next hearing has been fixed for November 10.

The PML-N-led federal government imposed the emergency and governor's rule on October 11 under Articles 232 and 234 of the Constitution, citing rising terrorism and the provincial government's weak support for counterterrorism operations. Governor Faisal Karim Kundi is now running the province with an 11-member technocratic advisory council. The petitioners' lawyer argued the constitutional requirements were not met, saying an emergency needs war or external aggression, and that the provincial assembly, chief minister and cabinet were all in place. Gohar told the court that 12 of his party's MNAs and 13 MPAs had been abducted and party offices demolished, claiming his party was being treated differently from others. Parliament has already approved the measures in a joint sitting, while the opposition alliance TTAP has ended talks with the Centre over what it calls unconstitutional steps.
