Texas Sues OpenAI and Sam Altman Over 'Deceptive' ChatGPT Safety Claims

OpenAI CEO Sam Altman

Texas Attorney General Ken Paxton has sued OpenAI and CEO Sam Altman, accusing the AI giant of deceptive trade practices. Filed on Friday, the lawsuit alleges that OpenAI marketed ChatGPT as safe and reliable while failing to protect users from harms including violent content, self-harm encouragement and privacy violations.

The complaint, brought under the Texas Deceptive Trade Practices–Consumer Protection Act, says the company put children and other vulnerable users at risk. It also accuses OpenAI of abandoning its founding non-profit mission in a rush toward rapid commercial expansion.

The case is one of the most aggressive moves yet by a US regulator against a leading AI lab, and it lands as lawmakers and courts around the world debate how much responsibility AI companies bear for what their chatbots say and do.

OpenAI has not yet publicly responded to the suit. If Texas prevails, the case could open the door to a wave of similar actions from other states — and force the industry to rethink how it markets the safety of its most powerful models.
