Texas Sues OpenAI Over ChatGPT Safety, Seeks Ban for Minors

The state of Texas has sued OpenAI and its chief executive Sam Altman, accusing the company of breaking state consumer-protection and child-online-safety laws with its ChatGPT chatbot. The petition, filed against six OpenAI entities, asks a court to bar ChatGPT from being offered to minors in Texas and to require a court-approved independent evaluator to sign off on safety guardrails before new AI models are released to users in the state.

Texas is seeking a civil penalty of $10,000 per alleged violation, plus more than $1 million in total monetary relief, disgorgement of profits and a jury trial. The state alleges ChatGPT's safety measures fall short of what Texas law demands for young users, at a time when chatbots are under growing scrutiny over their effects on children and teenagers.

OpenAI said it works with experts to improve ChatGPT, reduce risks and add safeguards, and that it supports safety standards applied across the AI industry. The case lands as governments worldwide wrestle with the same question: how to let powerful AI tools reach young users without exposing them to harm, and it could set a precedent other states follow.
